Answer

What will constitute valid gifting? Question: Muhammad owns a property. He was thinking of giving his wife half ownership of the property and may have made an intention in his heart to gift it. He never told her verbally directly or indirectly about this and as far as she is concerned it belongs to him. Neither did he tell anybody else or wrote anything about it. He later decided against giving it. Does he still own the full property or does his wife now own half? Answer: In the Name of Allah, the Most Gracious, the Most Merciful. As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. The entire property belongs to the man. The wife will only become an owner, of the prescribed share, once the property is transferred into the ownership and possession of the wife.[1]   And Allah Ta’āla Knows Best Abubakr Seedat Concurred by: Hanif Patel Mu‘adh Chati Asmar Akram Approved by: Mufti Siraj Sitponi Falahi
